- All properties are non-smoking and no pets permitted (In units where pets are permitted, a $200 per pet fee is required)
- Minimum age to reserve a property is 25 years old
- A Security Deposit (refundable) OR the purchase of Damage Protection Insurance ($64) is required
- Properties are not handicap accessible
- No motorcycle or trailer parking available at rentals, with the exception of private homes (limits may apply based on property)
- For last minute bookings (arrival within 30-days), payment is required at time of booking
- Payment cards (credit or debit cards) are subject to a 3% (US) or 5% (International) transaction fee
PROPERTY RENTAL AGREEMENT (unit specific Rental Agreement will be issued with confirmed booking)
- This Lodging Agreement (hereinafter referred to as (“Agreement”) must be signed by the Guest and returned to Owner Direct Vacation Rentals (ODVR) upon receipt. Please keep a copy for your records. Unit cannot be reserved or confirmation sent, without rental deposits as outlined. Guest signing this Agreement must be the person to check-in and must be 25 years or older or Owner/Property Manager reserves the right to refuse occupancy. Guest must occupy the property during the entire period and shall be responsible for all occupants on the premises. The occupancy shall not exceed the number of persons identified as a MAXIMUM OCCUPANCY of the specific unit booked.
- Guest Services Package is not optional and includes check-in/out services, property inspection, exit cleaning, bed/bath linens, discount dining/golf card, welcome packet of local maps, coupons, etc., starter supplies with paper products, soaps, etc.
- Guest agrees that this Agreement may not be assigned or the property may not be sublet for any reason.
- Guest shall not be entitled to any refund for inoperative appliances, air conditioners or other deficiencies. Owner/Property Manager, however, upon being notified of any malfunction, will make every reasonable effort to have same repaired or corrected. Replacement or repair of TV’s, microwaves, VCR’s, DVD’s and telephones cannot be guaranteed
- LONG TERM RENTALS: Owner will provide copies of monthly electric bills and Guest will be responsible to pay excess of electric bills over $(specific to unit) for any month of the rental term.
CANCELLATION POLICY: (If you do not purchase Travel Protection Insurance)
- All requests to cancel a reservation must be made in the form of a signed letter or email.
- If the property is not re-rented for the full amount, all monies received will be forfeited. If property is rented for a discount of the full amount, the renter is responsible for the difference in the rental amount plus 5% admin fee of the original rental.The reservation will be in effect upon receipt of deposit and the cancellation policy will apply at that time.
- ODVR/Property Manager must be notified if Guest is arriving later than check-in day or the reservation may be cancelled. If the reservation is cancelled, all monies received will be forfeited if the Property is not re-rented.
- There will be no refunds by the Owner for inclement weather, including hurricanes or forced evacuations or any reason beyond the control of the Owner. This includes any unforeseen maintenance issues.
- If the property owner cancels the reservation, due to unforeseen circumstances, every effort will be made to place the guest in a like property, if available and acceptable to guest. If we are unable to do so, all monies received will be refunded to the guest.
- Refunds will be released to Guest after original departure date, less a 5% administration fee and subject to the above conditions.
LODGING TERMS:
It is understood and agreed by all Parties to this Agreement that:
- Check-In is at (set by property) pm or later. We reserve the right to delay the check-in process as much as needed to insure the unit is completely cleaned and any maintenance issues are addressed. Delays can be expected, especially during peak season and check-in time cannot be guaranteed.
- Check-Out is at 10 a.m. or before. Check-out time means you have returned all keys to our office by 10:00 am and your belongings are out of the unit. A late check-out will incur a $100 late departure fee.
- Guest is granted a non-exclusive, revocable license for the use of the Property during the Reservation Period. Owner/Property Manager may have access to the Property in the event of an emergency or for the purpose of inspection, maintenance or repair.
Owner/Property Manager may terminate this agreement and, at the sole discretion of the Owner, for unforeseen circumstances, and/or remove Guest at any time if Guest becomes objectionable, violates any of the terms of the Agreement, violates any rules or regulations of the property or any City/Town Ordinances. Guest agrees to immediately vacate the Property without refund and Owner/Property Manager shall not be liable for any damages, including, without limitations, incidental and consequential damages. - No Landlord/Tenant relationship shall exist or be deemed to exist by virtue of the Agreement or the Guest occupancy of the property.
- For Long Term Rentals: Notice: If you do not pay your rent on time: This is your notice. If you do not pay your rent within (5) days of the due date, the landlord can start to have you evicted. You will get no other notice as long as you live in this rental unit.
The laws of the State of South Carolina in which the property is located shall govern this Agreement. - GUESTS ARE PROHIBITED FROM SMOKING IN OR AROUND THE CONDO OR HOME, NEAR DOORS, WINDOWS OR VENTILATION SYSTEMS THAT CAUSE SMOKE TO ENTER THE BUILDING OR CONDO. THIS IS IN ACCORDANCE WITH THE NORTH MYRTLE BEACH SMOKING BAN EFFECTIVE MAY 2011; VIOLATION OF THIS BAN WILL RESULT IN FINES FROM $100-$500, IMMEDIATE EVICTION, AND LOSS OF FULL SECURITY DEPOSIT+ COSTS TO IONIZE AIR.
- Guest agrees that any action brought by either arising out of this Agreement, or to enforce this Agreement shall be brought in the county in which the property is located. The parties hereto each specifically waive any venue, except as set forth above.
- Guest hereby agrees to hold and save harmless Owner/Property Manager, for injuries to persons or Property by reason of any cause whatsoever either in or about the Property or elsewhere.
- Guest may inspect the Property before paying a deposit. If Guest chooses not to inspect the Property, and then Guest agrees to accept the Property as is on arrival and Guest will not be entitled to a refund of rent money and will have no claim or recourse against the Owner/Property Manager.
- The property shall not be used for any commercial activity or illegal activity or purpose that is a violation of any regulation of any governmental authority that has jurisdiction over the Property.
- The Property is located within the town limits of North Myrtle Beach, Myrtle Beach or Horry County. Guest agrees to abide by the “Noise Control Ordinance” adopted that makes it unlawful to cause or permit noise levels that exceed established levels. (COMAR It is in violation of the Agreement and grounds for immediate eviction if these noise levels are exceeded as a result of the Guest’s activities on the Property.
DAMAGES:
- Guest agrees to surrender possession of the Property at the expiration of this Agreement, peaceably and without delay. With the exception of reasonable wear and tear, Property must be in the same condition as it was at the commencement of occupancy.
- Guest is financially responsible for any damage inflicted upon the Property during his stay. Your signature below authorizes us to charge your credit card or loss of full security deposit for damages exceeding the security deposit or charging you for anything not covered by the Damage Insurance. Owner/Property Manager will inspect the Property at the conclusion of the reservation period.
- Guest agrees to pay an excessive housekeeping fee if Property is not left in a neat and orderly condition. Toilets shall not be used for any purpose other than that for which they were intended. No sweepings, sanitary products, diapers, rubbish, rags or garbage shall be placed therein. Any sewer line clog caused by Guest shall be repaired at the expense of the Guest. Guest will reimburse Owner/Property Manager for any damage caused by escape or overflow of water.
- Guest will be charged for any unnecessary maintenance calls.
- Damage Protection Insurance will not cover any damage that occurs if you are in violation of the lease agreement. This includes, but is not limited to:
- smoking in a non-smoking condo or house
- bringing pets into a non-pet condo or house
- intentional acts, misuse or gross negligence of the property and/or contents
RULES AND RESTRICTIONS:
Usual CHECK-IN TIME IS (unit specific), however, your check in time may vary due to circumstances beyond our control, especially during peak season. CHECK-OUT TIME IS 10 a.m. (IN OUR OFFICE). After 10 a.m. a late check-out will incur a fee to guest of $100.
Property is cleaned between 10:00 AM to 3:00 PM between confirmed reservation periods. If Guest does not contact Property Manager within one hour of check-in, Property Manager will assume the unit is in good condition and acceptable.
Guest agrees to complete the following before vacating the Property. (1)Put all dirty dishes and utensils in dishwasher and turn the dishwasher on; (2) Remove all food from the refrigerator; (3) Remove all dirty sheets and pillow cases from beds, leave mattress pads, pillow shams, bedspreads or comforters, dust ruffles, decorative pillows, on each bed and leave all dirty linen, towels, etc in the bathroom; (4) Rearrange furniture to its original placement; (5) Check all drawers and closets for Guest belongings; (6) Turn off all lights. Close and lock all windows and doors when leaving; (7) Remove all trash; (8) Return all keys, parking passes, pool tags, fobs, card keys, etc. provided for Property to ODVR and vacate Property by 10 a.m. (9) Set A/C to 74 degrees.
Long distance calls must be made by credit card or calling card. Phones are restricted to local and toll free calls only.
Owner/Property Manager, without liability, may dispose of Guest belongings left in the Property after the Property has been vacated. Owner/Property Manager is not responsible for any theft. Please do not contact Owner/Property Manager for the purpose of recovering lost items.
GUESTS ARE NOT ALLOWED TO BRING PETS OR ANIMALS ON THE PROPERTY. VIOLATION OF THIS RULE AND RENTAL AGREEMENT SHALL BE GROUNDS FOR IMMEDIATE EVICTION OF THE GUEST, LOSS OF SECURITY DEPOSIT AND CHARGES TO YOUR CREDIT CARD FOR EXTRA CLEANING OR DAMAGE. (Pet Friendly units will not include this clause)
Minimum age for all renters is 25 years of age. Violation will result in immediate eviction of all guests.
Guests agree to abide by the building’s rules and regulations including any parking limitations set by the city, homeowner association or other governing body. Guest will not do any barbecuing on the balcony. Motorcycles, Trailers, RV’s and Boats are not allowed on premises or any public street.
Guest agrees that, pursuant to DHEC (Department of Health and Environmental Control) regulations, no glass of any kind or any other material that may be a hazard to bathers’ feet or bodies will be allowed in the pool area (in pool or on pool deck).
If Guest locks himself out of Property and Property Manager cannot be contacted, then Guest will be responsible for any locksmith charges.
Owner/Property Manager has made no representations, agreements, undertakings or promises, whether oral, implied or inferred, unless expressly stated herein.
